This research paper provides a comprehensive comparative analysis of the impact of Instagram and X (formerly known as Twitter) on freedom of speech and expression. With the rise of social media platforms, public discourse has increasingly migrated online, were digital communication shapes societal norms and democratic participation. This study examines the distinct policies, user experiences, and notable cases of censorship and free speech controversies on Instagram and X to understand their respective influences on freedom of speech.
Employing a doctrinal methodology, the research analyzes primary legal sources, platform policies, and case law, supplemented by empirical data on user engagement and moderation practices. The findings reveal significant differences in content moderation strategies: Instagram relies heavily on automated image recognition systems and human moderators, often resulting in contextually erroneous decisions, while X employs sophisticated text-based algorithms and user reports, which can misinterpret nuances like sarcasm and irony.
