Role of the Supreme Court of India in the Development of Environmental Law


Introduction:-

Since last two decades, Supreme Court has become very concerned towards the matters related to environment of India. Earlier, executive and legislative look after everything related to environmental law but now judiciary has became a major part of it. Now all the disputes and problems are resolve by judiciary. Development of environment has only became possible by the continuous efforts of Judiciary.

Constitution has allotted the task of development and settlement of dispute to the judiciary. Supreme Court has made new standards for the environmental protection. It has established many conventions usually the traditional ones to understand and work on the technical matter of the Environment. 

To follow the rule of law, the Supreme  court has made different principles and fundamental rights which aimed at protection and development of the proprietary rights of the people. Supreme court is extremely active in safeguarding such matters.

Public Interest Litigation has play a very crucial role in the process of development as all the decisions of Supreme court resulted in it’s formation. It has been marked as the most strong sword for the preservationist and conservationist. PIL is a tool for judiciary to prevent the environment. 

“The word “environment” relates to surroundings. It includes virtually everything. It can be can defined as anything which may be treated as covering the physical surroundings that are common to all of us, including air, space, land, water, plants and wildlife.”
